Services & "Third-Party" Sites
- The Services may contain links to "third-party" Sites that are not owned or operated by Good Fruit. Good Fruit does not control and, therefore, assumes no responsibility for, the content, policies, or practices of any "third-party" Sites. You hereby release Good Fruit from any and all liability arising from your use of any “third-party” Sites.
Changes to these Terms
The Website is only intended for use by people residing in Australia. We do not accept orders from individuals outside Australia. Customers must provide a valid email address and credit card for all orders accepted online.
By placing an order through our site, you warrant that:
- you are legally capable of entering into binding contracts; and
- you are at least 18 years old; and
- you are resident in one of the Service Areas
Acceptance or Rejection of an Order
We reserve the right to accept or reject an Order for any reason, including if the requested Product is not available or if there is an error in the price or the Product description posted on the Site or in an Order.
If we reject an Order, we will endeavour to notify you of that rejection at the time you place an Order or within 7 days after you submit an Order.
You are not permitted to purchase any items for resale to a third party or for trade purposes. If we have a concern with the quantity of item/s you have ordered, we will endeavour to contact you when you place an Order or within 7 days after you submit an Order.
Contents of your Box.
The contents of your box will change week to week depending on the time of year, and what we're told is looking good by our farmers and distributors. We always try to get a nice selection out to the customer.
We will email you during the day of your delivery letting you know that your order is arriving that day, with a receipt. We will generally post your upcoming order’s box contents to your account by midnight, usually 7 days prior to, but at a minimum of 3 days prior to your scheduled delivery.
You will also generally receive an email before your scheduled order alerting you that your box is ready to be viewed and that you can make substitutions, change quantities, add, and remove items from your box. If you are not receiving the emails, please call or email us and we will do our best to remedy the situation. From time to time an item that is listed in your cart may not come in your box. If an item arrives that we are not satisfied with we will turn it away, and if we feel we have an acceptable substitution will replace it with another item. If you are unhappy with the item that we have chosen to substitute in please let us know within 24 hours and we'll remedy the situation, generally through crediting your account for the item.
Payment for all Products must be by credit or debit card or PayPal. All transactions are processed in Australian Dollars. We accept payment with American Express, Visa and MasterCard. It is the customer's responsibility to notify us of a change in cards or an expired card. We do not accept checks. Once you sign up for our service you will get a box delivered to your desired location until we hear otherwise from you by cancelling, skipping, or modifying your account as instructed through the Services, or by calling us at 08 6107 5192. We will bill the fees due under your subscription to the credit card you provide to us during registration (or to a different credit card if you change your payment information) and continue to do so with each order you receive. You acknowledge that the amount billed for each renewal period may vary due to promotional offers, changes in your subscription, changes to box contents, and changes in applicable taxes, and you authorise us to bill you the corresponding amounts. Any changes to your account must be done via our Services or by calling and speaking with a live person. If you need any help with our online system please give us a call at 08 6107 5192. Any changes to your order must be done before your order is locked for the week, or as otherwise set forth on the Services. We're unable to make any changes to your order after the deadline. If you attempt to make a change after your deadline and the Services accepts it, there's a possibility that those changes won't be made. We are not responsible for this and you shall be responsible for any orders not cancelled as set forth herein. We will not make a delivery if you have an unpaid bill with us; payment information will need to be updated not less than 24 hours prior to your next order being locked.
We reserve the right to pre-authorise your credit card the day before your delivery arrives and cancel the order if funds are not available. If you ever have a billing discrepancy please give us a call and we will be sure to do our best to straighten it right out.
The minimum value of items in your cart will need to be $17.99 + $5 delivery fee, if your order total is below that amount we will not deliver your order.
We do our best to get your delivery to you before 9pm on your scheduled date of delivery. This time may be earlier or later during inclement weather or other unforeseeable delays and we reserve the right to change the delivery date or time without notice in such cases. We reserve the right to change your delivery day at any time, although we will try to provide you as much notice as practicable before a change. Notice will be given via our Services, and in our sole discretion, an email.
There is no need for you to be home at time of delivery. Just give us a place to leave your box. Please feel free to leave your previous week's box out on your delivery day the following week so we can recycle the box or re-use certain packing materials. Drivers are not responsible for relaying messages back to the office. The drivers are instructed to take any box back to our warehouse that the customer refuses, although we reserve the right to charge you for that box consistent with these terms. Drivers are asked not to pick up checks. We will not make a delivery if you have an unpaid bill with us.
If you are unhappy with your Product for a legitimate reason such as:
- the box was missing ingredients;
- the box was damaged; or
- the box did not arrive,
We will offer an appropriate refund if it can be shown that the Product you were charged for was not provided as it should have been. Depending on the circumstances, we may, in our sole discretion, provide a full or partial refund of the purchase price, or provide you with Credits to be applied to future deliveries. You must contact customer service at firstname.lastname@example.org or on 08 6107 5192 within seven (7) days of receiving your delivery to qualify for a refund.
You should enter your postcode and address in our Services to see if we deliver to your location. Deliveries made to offices and apartment buildings may need to be left with a secretary or apartment manager and it is your responsibility to collect. We'll do everything in our power to get your order to your door by 9 p.m., but please know we cannot guarantee this time. And whatever you do, please don't sign up with a P.O. Box. We can't deliver to a P.O. Box!

Vouchers and Gift Cards
We may offer gift cards, discount promotions and other types of vouchers (Voucher) which require to be activated by email application in order for the holder to commence delivery of Products. If paid for, the Voucher is deemed to have been sold at the time of payment for it. All of these terms and conditions shall become applicable as between us and you when you redeem the Voucher by purchasing a Product.
Any Voucher may only be used once by you and may not be copied, reproduced, distributed or published either directly or indirectly in any form or stored in a data retrieval system without our prior written approval. Only one voucher is allowed to be applied per order.
We reserve the right to withdraw or cancel any Voucher (other than a paid-up gift card) for any reason at any time.
Vouchers may only be redeemed through the Website and not through any other website or method of communication. To use your Voucher you will be required to enter its unique code at the online checkout and use of such code will be deemed to confirm your agreement to these terms and conditions and any special conditions attached to the Voucher.
Any discounts attached to Vouchers apply to the price of the Products ordered only and not to delivery charges, which will be chargeable at normal rates.
We reserve the right to exclude the use of voucher codes on specific products.
Risk and Title
The Products will be at your risk from the time of delivery.
Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.
These terms and conditions are governed by the laws in force in Western Australia. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
Good Fruit does take reasonable care in creating the information on this website, this website and its contents may contain errors, faults and inaccuracies, and may not be complete or current.
Accordingly, use of this website is entirely at your own risk, and we make no representation or warranty of any kind, express or implied, as to the operation of this website, or as to the information, content, materials, suppliers or products included on this website.
To the extent that this website might contain links to websites operated by third parties, we have not endorsed or approved such other websites, or the information and materials on those websites.
Subject only to any responsibility or liability implied by law which cannot be excluded, we are not liable to you for any losses, damages, liabilities, claims and expenses whatsoever relating to or arising out of information, materials or services provided on or through our website, and where any responsibility or liability cannot by law be excluded, our liability is limited, to the extent possible, to the supply of the goods or services again, the repair of goods, or the payment of the costs of having the goods or services repaired or supplied again.
